1. Respect for Intellectual Property
Tropilo respects the intellectual property rights of others and expects all users to do the same. We respond to notices of alleged copyright infringement in accordance with the Malaysian Copyright Act 1987 and international best practices.
2. AI-Generated Content Notice
A significant portion of content on Tropilo is generated using artificial intelligence technologies, including text content (generated by large language models) and images (generated by AI image models). While AI-generated content is created using original prompts and parameters, we acknowledge that AI models are trained on broad datasets and may occasionally produce content that resembles existing works. If you believe that any AI-generated content on Tropilo infringes upon your copyright or intellectual property rights, please follow the reporting procedure outlined below. We take all infringement claims seriously and will act promptly to investigate and resolve them.
3. User-Submitted Content
Users who submit content to Tropilo are solely responsible for ensuring that their submissions do not infringe upon any third party's intellectual property rights. By submitting content, users represent and warrant that they own or have obtained all necessary rights, licenses, and permissions for the content they upload. Tropilo reserves the right to remove any user-submitted content that is found to infringe upon copyright or other intellectual property rights, with or without prior notice.
4. How to Report Copyright Infringement
If you believe that content on Tropilo infringes your copyright, please send a written notice to our designated agent with the following information: a) A description of the copyrighted work that you claim has been infringed. b) A description of the content on Tropilo that you claim is infringing, including the specific URL(s) where the content appears. c) Your full name, mailing address, telephone number, and email address. d) A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law. e) A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner. f) Your physical or electronic signature. 5. Response Process
Upon receiving a valid copyright infringement notice, Tropilo will: a) Acknowledge receipt of your notice within 3 business days. b) Investigate the claim and review the identified content. c) If the claim is valid, remove or disable access to the infringing content promptly, typically within 5-7 business days. d) Notify the content uploader (if applicable) that their content has been removed due to a copyright claim. e) Keep a record of the notice and our response for compliance purposes. For AI-generated content found to infringe copyright, we will also take steps to prevent similar content from being generated in the future.
6. Counter-Notice
If you believe that content was removed in error or that you have the right to use the material, you may submit a counter-notice to [email protected] with the following: a) Identification of the content that was removed and its former location on the platform. b) A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification. c) Your name, address, and telephone number. d) A statement that you consent to the jurisdiction of the courts of Malaysia. e) Your physical or electronic signature. Upon receiving a valid counter-notice, we will forward it to the original complainant and may restore the content within 10-14 business days unless the complainant initiates legal proceedings.
7. Repeat Infringers
Tropilo maintains a policy of terminating access for users who are repeat copyright infringers. If a user receives multiple valid copyright complaints, their account and content may be permanently removed from the platform.
8. Image & Photo Rights
Images on Tropilo come from the following sources: • AI-generated images: Created using AI image generation models with original prompts. These images are unique to Tropilo. • User-uploaded images: Submitted by users who warrant they have the right to use them. • Merchant-provided images: Submitted by merchants as part of their partnership application. If you find an image on Tropilo that infringes your rights (including portrait rights, trademark rights, or copyright), please follow the reporting procedure in Section 4.
9. Good Faith
Please note that filing a false or misleading copyright infringement notice may result in legal liability. Before submitting a notice, please consider whether the use of the content may constitute fair use or fair dealing under applicable law.
